Robert de Sorbon’s Cum repetes — or De modo audiendi confessiones et interrogandi as it is called in the Bruges manuscript — is for the clergy what Robert’s Qui vult vere confiteriis for laymen. It is a guide for confessors, specifically addressed to those charged with the cura animarum to provide practical instruction on how to interrogate the penitent and assist him in examining his conscience. It is this subject that determines and delimits its scope. In terms of the tripartite (...) nature of the sacrament of penance, i.e. contrition, confession and satisfaction, Cum repetes concentrates almost exclusively on the central part, confession, and on the proper method of interrogation by the confessor. A characteristic feature of Robert’s treatise is the introduction of a number of model dialogues between the confessor and the penitent, comparable to the interchanges in Robert of Flamborough’s Liber Poenitentialis, but much more incisive and inspired by great sollicitude as well as personal involvement. This study presents examples, not previously available in print, of the frequent use of the imagery of commerce in Robert de Sorbon’s sermons and discusses the imagery’s relation to scriptural and patristic sources, in particular the apostle Paul and Augustine of Hippo. It is argued that Robert’s use of the language of the marketplace in discussions of theological and moral matters functions as a rhetorical tool which emphasizes the boundlessness of God’s mercy through the redemption.

In this article, we investigate the political theology of populism and look at the case of the Front National. Considering the writings of Carl Schmitt and Ernesto Laclau, we trace the logical core of Schmitt’s political theology and show how it is integrated into theories of the political and Laclau’s theory of populism. We argue that the theologico-political core of populism is the simultaneous disavowal and imposition of mediation and that this stance leads to an increasing formalism. Looking at the (...) discourse of the FN on the notion of laïcité, we find that this theologico-political structure explains how the party is able to link traditionally left- and right-wing motives in its discourse. Finally, we show how in FN’s discourse, the formalist tendency of populism, which Laclau has theoretically explicated, has become overt and must be understood as part of politics, not as a universal and tran-historical logic of the political. Contemporary moral philosophers generally claim that there is both a moral and a nonmoral sense of such key terms as "ought" and "right." Professor Wertheimer attempts to disprove this claim as well as the significance of contemporary metaethical investigations by establishing that such terms, especially the modal auxiliary verb "ought," are univocal, and, as a result, that a proper understanding of them will reveal nothing about the nature of morality. Wertheimer defines "n ought to v" as a conjunction of the (...) following clauses: 1) There exists an adequate relevant System y; 2) there exists a property F such that "Fn" is true; and 3) according to y, F is such that if "Fn" is true, and C obtains then "nv" is true. A crucial point about this definition is that the truth of "ought" statements is always defended by an implicit reference to the existence of an adequate relevant system; "ought" statements in science are based on an adequate scientific system, moral "ought" statements on an adequate moral system. Thus, a decision about the truth of such statements is not a semantic issue, but one of assessing the adequacy of the system appealed to. This view of "ought" statements along with a similar one of other moral terms is the basis of Wertheimer’s provocative contention that metaethics, which has received the major share of moral philosophers’ attention in the twentieth century, is bound to be unproductive. Purpose The purpose of this study is to demonstrate the applicability of Multi-Criteria Decision Analysis (MCDA) through a systematic approach using M-Macbeth to present alternatives for mitigating high-impact instances of disinformation in a community and measure the attractiveness of the options. Design/methodology/approach The recent advent of Fake News (FN) and disinformation poses a significant threat to a community, organisation or individual, contributing to the erosion of public trust in institutions and democracy. This is aggravated should the authors consider the multiplicity (...) of FN and, thus, the multitude of risk and their impact on the community. This research proposes tackling FN as a digital risk by applying an MCDA to select the appropriate countermeasures for Law Enforcement Agencies to tackle disinformation and FN crimes. Findings Results indicate that to mitigate risk effectively, prioritising risk using adequate strategies and appropriate courses of action is crucial. Originality/value Nevertheless, the contributions of this research work allowed us to comprehend the best option to mitigate the risk of FN and provide a realistic approach to support Law Enforcement in decision analysis. All agree that the overall production of food in the world is adequate for everyone's nutritional needs. The article demonstrates that there are two main approaches in the debate on food production. The dominant approach focuses primarily on food security, understood as increased food production and increased food trade. The other approach argues that the interests and rights of the most vulnerable must prevail, and that improvements for the vulnerable are best ensured with a strategy based on human rights. The article analyzes land distribution, increased use of genetic technology in agriculture and reduction of trade barriers for agricultural products. Industrialization of agriculture and the liberalization of trade in agricultural products can provide good results at the macro level – in the short term. If the goal is to promote the situation of the most vulnerable and at the same time addressing climate change, the solution is a bottom-up approach, which until now has been ignored by most states. The primary goal of this monograph is to justify the possibility of building a hybrid theory of normative ethics which can combine ethical consequentialism, deontology and virtue ethics. The aim of the book is to demonstrate the possibility of constructing a synthetic theory from ethical traditions that are generally considered to be contradictory. In addition, I propose an outline of an original theory which tries to carry out such a synthesis. I call it Institutional Function Consequentialism. The justification for a (...) hybrid theory of normative ethics requires the resolution of certain meta-ethical issues. I discuss them in part 1.1. After a brief overview of my research aims I consider the answer to the following questions: “What kind of meta-ethical beliefs must we assume for normative ethics?” and "Why should we build ethical theories?". I also discuss the various forms of ethical scepticism, which should be rejected if we develop a hybrid theory of normative ethics. I also describe possible methods of justifying any ethical theory. At the end of part 1.1 I explain that the best method for justifying any ethical theory is the method of wide reflective equilibrium. In parts 1.2, 1.3 and 1.4 I analyse three main types of normative ethics which are considered to be competitive: consequentialism, deontology, and virtue ethics. Part 1.2 is about consequentialism and its difference between utilitarianism and teleological theories. I also present the main reasons for the popularity of consequentialism. In part 1.3 I define deontology, present its variations and show important benefits that motivate its continuous growth. In part 1.4 I discuss virtue ethics, which is often referred as the viable alternative to consequentialism and deontology. If we want to build any new ethical theory, first we should describe the problems of the old ones. For this reason, in chapter 2 I describe the most important arguments against ethical consequentialism, and in chapter 3 I explain the difficulties of deontology. Critical remarks on virtue ethics are considered in part 1.4. The last two chapters directly concern the main aim of the monograph. Because in chapter 3 I show that deontology suffers from a number of problems such as the paradox of deontology, in chapters 4 and 5 I present only consequentialist versions of hybrid theories. These versions try to avoid the common pleas of utilitarianism and combine the advantages of opponents to utilitarianism. I answer the question (4.1) "What is hybrid consequentialism?" and briefly describe (4.2) the most important examples of hybrid theories by others. I discuss the prerogatives without restrictions idea by Samuel Scheffler, rule consequentialism by Brad Hooker, Kantian consequentialism by Richard M. Hare, David Cummiskey and Derek Parfit and consequentializing procedure proposed by Douglas W. Portmore. In the last chapter I present a new hybrid version of consequentialism that I call Institutional Function Consequentialism. I start from the thesis (5.1) that traditional meta-ethics of analytic philosophy incorrectly defines the main field of its research. Rather than focusing on the philosophy of language and metaphysics it should try to answer one question: “What should morality and ethics be for?”. Therefore I introduce an original methodology for meta-ethics that I call the Functional Model of Analysis (FMA). It is a meta-ethical framework in which the fundamental questions concern the practical functions of normative domains such as morality and ethics and the most rational way of achieving them. FMA is meta-ethical project that (a) explains the persistence of fundamental ethical disagreement among experts, (b) sets the background for explaining or justifying the correct structure of the ethical theory, (c) gives the possibility to create a hybrid theory of normative ethics. In part 5.2 I formulate a generalized argument against various popular theories of normative ethics which states that most of the popular theories are too narrow and one-sided, causing permanent dispute between them. There are many distinct practical functions of morality that are usually based on different types of normative theories such as Aristotelian ethics, utilitarianism, contractarianism and contractualism. In order to remove these conflicts, the correct ethical theory should try to take into account all of these relevant features of moral life. Unfortunately, most ethical theories are mono-functional. This means that their supporters consciously or unconsciously (1) recognize or accept only one genuine practical function, (2) think that this one practical function overrides all other practical functions or (3) try to reduce all practical functions to the one that is chosen. In part 5.2 I present a description and justification of a new normative account that I call Hybrid Function Consequentialism. The formal scheme of this consequentialism can be summarized in the following way: we should act according to some important focal points P1…Pn with contents C1…Cn that are selected on the basis of considerations about which kind of P with C will bring the best realization of the best mix of normative functions F1...Fn. In the next part (5.2.2) I present the new way of “consequentializing” particular theories of normative ethics by applying the scheme of Hybrid Function Consequentialism. As an example of the use of this procedure, I formulate perfectionist virtue consequentialism, contractarian institution consequentialism, contractualist rule consequentialism and consequentialism of salvation. In part 5.3 I formulate an original theoretical concept that I call Institutional Function Consequentialism (IFC). It is a hybrid theory that is based on the previously described Functional Model of Analysis and a reflection on the role of institutions in modern developed societies. IFC claims that we should always act according to some rules, virtues, motives and intentions that constitute the homeostasis of normative institutions whose internalization by the overwhelming majority of each new generation has maximum expected value in terms of the best realization of the equilibrium of the most important practical functions of normative domains. Responsibility and sanctions related to wrongful actions should be dependent on the particular institution whose standards have been violated. IFC has several unique features which are described and justified in part 5.3. It is a form of hybrid consequentialism – it mixes features of consequentialism, deontology and virtue ethics. It does this on three different levels: justification, structure and content. The main focal point of the theory is not rules or virtues, but normative institutions. Values to be optimized in the framework of consequentialism are not "happiness", "well-being" or "preferences", but the fulfilment of normative functions. IFC is not limited to the field of ethics only, but it is a meta-normative account of justification for an entire social order which is comprised of a number of different institutions. It also assumes a specific, circular relationship between practical ethics (e.g. research on such important issues as civil disobedience, fair distribution of wealth, philosophy of punishment or autonomy of conscience), and the content of the general rules that may constitute the optimal homeostasis of institutions. It rejects the simplistic belief that moral thinking is based solely on deductive implications from general ethical principles or meta-ethical beliefs. (shrink)

Carl Gillett Department of Philosophy Northern Illinois University Suppose that scientists discover a high level property G that is prima facie multiply realized by two sets of lower level properties, F1, F2, …, Fn, and F*1, F*2, …, F*m. One response would be to take this situation at face value and conclude that G is in fact so multiply realized. A second response, however, would be to eliminate the property G and instead hypothesize subtypes of G, G1 and G2, and (...) say that G1 is uniquely realized by F1, F2, …, Fn, and that G2 is uniquely realized by F*1, F*2, …, F*m. This second response would eliminate a multiply realized property in favor of two uniquely realized properties.[1] Clearly these are two logically possible responses to this type of situation, so when faced with it how do scientists respond in real cases? This is a matter of providing a descriptively adequate account of actual scientific practice. In support of the view that scientists opt for the “eliminate-and-split” strategy, one might propose that it is illustrated by the way scientists responded in the case of memory. Once upon a time, it was thought that there existed a single kind of memory. With the advance of science, however, it was discovered that it is possible to perform certain sorts of brain lesions that would lead to the selective loss of certain memory functions, while certain other sorts of brain lesions would lead to selective loss of certain other memory functions. These neurobiological dissociation experiments, one might say, support the view that, instead of a single overarching type of memory, there are distinct subtypes of memory, procedural memory and declarative memory. Thus, generalizing from this example, it might be suggested that the eliminate-and-split strategy is always the approach of scientists in such cases. We believe that this argument is based upon serious oversimplifications. This article documents how a serial plagiarism case discovered over a decade ago continues to generate negative effects in the downstream research on medieval and early modern philosophy. The ongoing positive citation of the 40 plagiarizing articles and book chapters – including those retracted by their publishers – affects the reliability of later scholarship in several ways. The present state of affairs is the joint result of authors, editors, peer reviewers, and publishers who continue to allow (and in some cases, (...) support) the publication of new works across a variety of genres that contain positive citations to the 40 plagiarizing articles and book chapters. The problem shows no signs of abating; the plagiarizing articles and book chapters continue to acquire positive citations in new publications, including authoritative reference works. The breach of research standards is further shown by the fact that even a non-existent publication by the plagiarist continues to acquire positive citations. (shrink)

The considerable attention to financial interests in clinical research has focused mostly on academic medical centers, even though the majority of clinical research is conducted in community practice settings. To fill this gap, this article maps the practices and policies in 73 community hospitals and several hundred specialized facilities around the country for reviewing clinical investigators’ financial relationships with research sponsors. Community hospitals face a substantially different mix of issues than academic medical centers do because their physician researchers are usually (...) not employees, and more of their studies are later-phase, multicenter trials. Accordingly, community physicians stand to benefit personally from per capita payments, but they tend to have less direct influence over research findings when compared with their academic peers. These and other contrasts require separate guidance for community-based organizations that takes into account their particular needs, circumstances, and institutional capacities. (shrink)

I take it as my assignment to criticize the Gauthier enterprise. At the outset, however, I should express my general agreement with David Gauthier's normative vision of a liberal social order, including the place that individual principles of morality hold in such an order. Whether the enterprise is, ultimately, judged to have succeeded or to have failed depends on the standards applied. Considered as a coherent grounding of such a social order in the rational choice behavior of persons, the enterprise (...) fails. Considered as an extended argument implying that persons should adopt the moral stance embodied in the Gauthier structure, the enterprise is, I dunk, largely successful. Considered as a set of empirically falsifiable propositions suggesting that persons do, indeed, choose as the Gauthier precepts dictate, the enterprise offers Humean hope rather than Hobbesian despair. Some patients have no chance of surviving if not treated, but very little chance if treated. A number of medical ethicists and physicians have argued that treatment in such cases is medically futile and a matter of physician discretion. This paper critically examines that position.According to Howard Brody and others, a judgment of medical futility is a purely technical matter, which physicians are uniquely qualified to make. Although Brody later retracted these claims, he held to the view that physicians need (...) not consult the patient or his family to determine their values before deciding not to treat. This is because professional integrity dictates that treatment should not be undertaken. The argument for this claim is that medicine is a profession and a social practice, and thus capable of breaches of professional integrity.Underlying professional integrity are two moral principles, one concerning harm, the other fraud. According to Brody both point to the fact that when the odds of survival are very low treatment is a violation of professional integrity.The details of this skeletal argument are exposed and explained, and the full argument is criticised. On a number of counts, it is found wanting. If anything, professional integrity points to the opposite conclusion. (shrink)

Philosophy of science is the organized expression of a growing intent among philosophers and scientists to clarify, perhaps unify, the programs, methods and results of the disciplines of philosophy and of science. The examination of fundamental concepts and presuppositions in the light of the positive results of science, systematic doubt of the positive results, and a thorough-going analysis and critique of logic and of language, are typical projects for this joint effort. It is not necessary to be committed to a (...) belief that science and philosophy are or should be one, or else that “never the twain shall meet.” If anything, there is to be expected a wholesome regard for the value of established science in furnishing a foil for philosophy and a check on its old extravagances. This does not mean that even the best-established science may not be subject to most devastating criticism by analysis of its foundations. In fact, despairing of the philosophy of the schools, science has done it largely for itself. The theories of gravitation, atomicity, electro-magnetism, evolution, relativity and quanta have all arisen through drastic revisions of complacent fundamental “truths.”. (shrink)

This volume is a compilation of revised versions of papers presented at a conference held in spring 1994 at the Centre for Interdisciplinary Research (ZiF) in Bielefeld, Germany.

Ketelaar and Ellis have provided a remarkably clear and succinct statement of Lakatosian philosophy of science and have also argued compellingly that the neo-Darwinian theory of evolution fills the Lakatosian criteria of progressivity. We find ourselves in agreement with much of what Ketelaar and Ellis say about Lakatosian philosophy of science, but have some questions about (1) the place of evolutionary psychology in a Lakatosian framework, and (2) the extent to which evolutionary psychology truly predicts new findings.

As synthetic biology develops into a promising science and engineering field, we need to have clear ideas and priorities regarding its safety, security, ethical and public dialogue implications. Based on an extensive literature search, interviews with scientists, social scientists, a 4 week long public e-forum, and consultation with several stakeholders from science, industry and civil society organisations, we compiled a list of priority topics regarding societal issues of synthetic biology for the years ahead. The points presented here are intended to (...) encourage all stakeholders to engage in the prioritisation of these issues and to participate in a continuous dialogue, with the ultimate goal of providing a basis for a multi-stakeholder governance in synthetic biology. Problem: The inclusion of the observer into scientific observation entails a vicious circle of having to observe the observer as dependent on observation. Second-order science has to clarify how its underlying circularity can be scientifically conceived. Method: Essayistic and conceptual analysis, sporadically illustrated with agent-based experiments. Results: Second-order science - implying science in general - is fundamentally and ineluctably circular. Implications - The circularity of second-order science asks for analytical methods able to cope with phenomena of complex causation and “synchronous (...) asynchrony,” such as tools for analyzing non-linearly interacting dynamics, decentralized, clustered networks and in general, systems of complex interacting components.
